Administrative Law
At Scaringi Law we understand how important your professional or occupational license is to you. You have invested significant time and resources in obtaining and maintaining your license. Your license is the key component of your professional life. It is also an integral part of your reputation. Most importantly, it enables you to provide for yourself and your family. We understand how essential it is to protect your license from any adverse action taken by any government authority. Because the government grants your license it can also take it away.
Many professions and occupations in Pennsylvania are regulated by state government. The Bureau of Professional and Occupational Affairs was established in 1963 as part of the Pennsylvania Department of State to provide administrative, logistical and legal support services to professional and occupational licensing boards and commissions.
Professional licensing is intended to protect the health, safety, and welfare of the public from fraudulent and unethical practitioners. There are 28 licensing boards and commissions, each with their own statute governing their powers and functions. The boards and commissions also promulgate regulations to further govern their respective professions.
The Department provides these boards and commissions with legal, technical and administrative support to do among other tasks: receive and investigate public complaints; conduct periodic facility inspections; and prosecute, adjudicate, fine and sanction violators.
The Bureau of Enforcement and Investigation provides the boards and commissions with facility inspection and law enforcement capabilities. The Bureau's central office is located in Harrisburg and it maintains regional offices in Philadelphia, Pittsburgh, and Scranton.
Any professional contacted by the Bureau of Enforcement and Investigation has the right and is well- advised to obtain legal representation. The attorneys at Scaringi Law are experienced professional and occupational licensing attorneys. Our attorneys represent professionals in every stage of an investigation, from the initial interview or contact with our client by the Bureau up to and including prosecutions, hearings, and appeals.
