Protecting Property Rights

Happy homeowner in hardhat in front of homeBy Keith E. Kendall

Know your property rights and be ready to defend them. Municipal agencies (boroughs, townships, municipal authorities - sometimes referred to as "local agencies") are required, by a litany of state laws and regulations, to act or not act in a way that negatively impacts your property rights.

In a recent local agency appeal, we were able to convince a local common pleas court judge to void a local agency permit that allowed a property owner to construct a driveway over our client's property, without his consent. If you believe that your property rights are or have been threatened by some act or omission of the borough, township or county in which you live, you should seek legal advice, to determine the legality of that local agency's action(s), that may negatively impact your property rights, to avoid a potential devaluation of your property.
